Scope of Work :

  1. To analyse and coordinate the Medicolegal Complaints faced by individual members. The Cell can advise the member facing the problem, on the best way ahead
  2. Medicolegal Initiatives by the Association, in various stages of implementation, such as :
    • Fight against Quackery by APSI
    • Revised Syllabus/Curriculum for Plastic Surgery
    • APSI approved consent forms

SCOPE of work of the Cell.
A. INCLUSIONS :
  1. Individual medicolegal problems of members - Pure Advisory role, for Corrective Remedy.
  2. Medicolegal efforts by the Association: these will ultimately help individual members mainly preventive in nature

Few we have already begun, few we can take up :
  1. Quackery by Dental Surgeons - proposal ready, to be discussed with DGHS; will be submitted to MOHFW as per DGHS inputs.
  2. Formalising a Plastic Surgery Curriculum/ Syllabus - Syllabus is prepared, getting it approved by MCI is pending.
  3. APSI approved Consent forms for commonly done procedures - I propose this is done at the earliest, it will be an ongoing process.
B. EXCLUSIONS :
  1. I do not feel we need to have a separate Legal Advisor, on a retainer basis. What i propose is to have a have a group indemnity with some existing provider of indemnity services... Once we have a Group indemnity, the Legal Advisors will automatically be part of the services, without any additional cost.
    I suggest whoever (Any Indemnity service provider) has handled maximum number of complaints (not highest number of clients), be selected.
    Indemnity provided by IMA PPF & by AMC Mumbai are two that come to my mind.
    This policy can be easily made optional for members. Also, Members can take an additional policy (separate from the one offered by APSI) , with a separate provider if they so wish. But no other policy will get them a member the inputs, that an experienced Medicolegal Cell can.
  2. Naturally, the Cell will not be party to any complaint against a member
  3. Complaint against Association???
